What you need to know to use other people's work legitimately in support of your learning, teaching and research

Circulating Extracts from Works in Copyright (Reading List and Course Packs)

Circulating a digital copy that has been scanned from a printed copyright work is equivalent to handing out multiple photocopies in a coursepack and both would come under the terms of the University's Copyright Licensing Agency Licence. However, if a reference to the extract e.g. a chapter from a book, a single graphic or image from a book or an article from a journal issue, is added to Leganto, Library staff will digitise the extract and ensure that it complies fully with the terms of the Licence. NB Where the extract is in an e-book or e-journal Library staff will link the reference in Leganto to the full text in the electronic copy. That way usage can be monitored and can be taken into account when the subscription to the electronic copy is up for renewal.

Why it is Important to use Leganto for Scanned Extracts

Making scanned extracts from printed books and journals available to students comes under the terms of our CLA License. These terms include the following:

  • The source publication must be included in the licence repertoire. There is an online tool on the CLA website to check this (Hint - just make sure you choose the HE licence form the drop down menu)
  • The amount of the source publication made available to a particular course (in any format e.g. as photocopies and digitised extracts) must not exceed the following limits:
    • 1 chapter from a book or 10% of the whole whichever is the greater
    • 1 short story or poem (not exceeding 10 pages) from an anthology
    • 1 article/paper from a particular issue of a journal or conference proceedings
    • 1 whole report of a single case from a published report of judicial proceedings
  • A coversheet prescribed by the CLA must be appended to the front of the extract
  • All such scanned extracts made available over the course of an academic year must be reported to the CLA on an annual basis (This is so that appropriate royalties can be paid to the rights holders which may include authors form this institution)

However, when scanned extracts are made available via Leganto, library staff will ensure that all the above are complied with.
